Terms of Service

1. Scope

These Terms of Service (“Terms”) govern your use of the Premtrace platform and services provided by Premtrace AG, Rue Terrassière 39, 1207 Geneva, Switzerland (“Premtrace”).

By subscribing to or using our services, you agree to these Terms. If you are subscribing on behalf of an organisation, you represent that you have authority to bind that organisation.

2. Services

Premtrace provides employee digital risk screening services, including but not limited to:

• Scanning of publicly available data sources
• Risk categorisation and severity assessment
• Generation and delivery of Intelligence Digests
• Risk indicator dashboards (Professional and Enterprise tiers)

3. Subscriptions and Payment

Subscriptions are billed monthly or annually as selected at the time of purchase. Payments are processed securely via Stripe. All prices are in Swiss Francs (CHF) and exclude applicable VAT.

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial periods.

4. Data and Confidentiality

Premtrace treats all customer data as confidential. Employee data uploaded for screening is processed exclusively for the purpose of providing our services and is not shared with third parties except as required to deliver the service (see Privacy Policy).

Intelligence Digests and screening results are confidential and intended solely for the subscribing organisation.

5. Public Data Only

Premtrace screens only publicly available information. We do not access password-protected content, private accounts, or any information that is not freely accessible to the public. The accuracy and completeness of findings depend on the availability and quality of public data.

6. Limitation of Liability

Premtrace provides screening intelligence for informational purposes. We do not provide legal, compliance, or HR advice. Findings should be reviewed and acted upon by qualified professionals within your organisation.

To the maximum extent permitted by Swiss law, Premtrace's liability is limited to the amount paid by the customer in the 12 months preceding the claim.

7. Acceptable Use

You agree not to:

• Use the service for purposes other than employee digital risk management
• Share screening results outside your organisation without authorisation
• Attempt to reverse-engineer or replicate the screening methodology
• Use the service in violation of applicable data protection laws

8. Governing Law and Jurisdiction

These Terms are governed by Swiss law. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Geneva, Switzerland.

9. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated to subscribers by email at least 30 days before they take effect.
